How do we make arrangements for the children when we separate?

Consistency is important for children, especially those who are already experiencing a big change in their lives when their parents are separating.

Where possible, parents should to engage in discussions and attempt to come to an agreement in respect of child arrangements, which will include where the children will live, how often they will spend time with the other parent and so on.

If it is not possible to reach an agreement, or if it is not appropriate for parents to engage in direct discussions, then mediation and legal advice should be considered to ensure there is as little delay for the children as possible in establishing a new routine.

 

Do we have to apply to the Court if we cannot agree arrangements for the children?

Here at Birkett & Co Solicitors we aim to resolve disputes outside of Court where it is appropriate to do so. If you and the other parent can come to an agreement in respect of the children, whether independently, via mediation or through negotiations, we can assist in drafting a Parenting Plan to set out the agreement that has been reached.

It is not always possible, or safe, to reach an agreement for many reasons, and in such cases it may become necessary to make a Court application.
